(BIPMARK) and Glenayre Electronics Inc. have signed a license and settlement agreement to resolve a patent infringement lawsuit filed in January by Atlanta-based BellSouth against Glenayre. As part of the settlement, Atlanta-based Glenayre has taken a non-exclusive patent license from BIPMARK for a specific one-number technology involving sequential routing to locate a user. Although Glenayre agreed to the terms of the license, it does not acknowledge either infringement or validity of the patent. The license includes royalties for past and future sales, but detailed financial terms were not disclosed. Index Conceptus and Ovion, Inc. (Nasdaq:CPTS), developer of the non-incisional permanent birth control procedure Essure(TM), today announced that the Company and Ovion, Inc. have arrived at an agreement to settle their ongoing patent infringement litigation matters. In the settlement, Conceptus will receive a sole license to Ovion's patent rights relative to the Essure system, and Ovion may not grant any additional such licenses to other parties. Ovion will not be granted any rights to Conceptus' intellectual property. The settlement also includes a $2 million prepaid royalty in cash to Ovion and a license fee of $2 million in stock payable in the first and second quarters of 2004. The royalty is a 3.25% fee that will be based on cumulative net sales in excess of $75 million running for a period of ten years for valid patent claims held by Ovion over the period. The settlement is subject to approval by the court. Index Padcom sues NetMotion Wireless for patent infringement http://rcrnews.com/cgi-bin/news.pl?newsId=15669 Padcom Inc. filed a patent infringement complaint against Seattle-based NetMotion Wireless and Database Solutions Inc., Wilmington, Del. The claims cover two patents on Padcom’s wireless roaming technology, which is primarily used in the public-safety and utilities industries. The claims against NetMotion and Database Solutions allege patent infringement, tortious interference with prospective contractual relations and business expectancy, and common law unfair competition.
