OMHEX to fight $64 million eSpeed patent suit

Swedish transaction technology vendor and exchange operator OMHEX says it will fight a $64 million patent lawsuit filed in the US by electronic broker eSpeed. OM Technology was named in a suit filed by eSpeed last year in connection with its delivery of software for electronic fixed income outfit BrokerTec, now owned by Icap. In court hearings, eSpeed has filed for damages of up to $64 million for infringement of its patent. In a statement, OM says it will vigorously contest the damages calculation and has re-asserted its belief that the eSpeed patent is invalid. The company intends to seek dismissal of the suit promptly following the conclusion of the discovery period on 30 June.

Ampex Corporation Initiates Litigation Against Sanyo

Ampex Corporation filed a complaint with the International Trade Commission seeking an exclusion order barring Sanyo Electric Company Ltd. from the importation and sale of digital still cameras and cellular phones with digital image storage and retrieval capabilities into the United States of America due to Sanyo's unauthorized use of the Company's intellectual property. The requested exclusion order would apply to digital still cameras and cellular phones with digital image storage and retrieval capabilities manufactured by Sanyo and sold in the U.S. under its own brand name as well as products manufactured by Sanyo under OEM agreements and sold under other manufacturers' brand names. Industry statistics indicate that Sanyo is the world's largest manufacturer of digital still cameras, with sales accounting for approximately 30% of the global market.

Wi-LAN's Patent Tollbooth On The Road To WiMAX

In what may be a portent of future legal conflicts, Wi-LAN, Inc. and Redline Communications said they have settled a patent dispute covering technology used in wireless broadband equipment. Specifically, Redline agreed to pay Wi-LAN royalties for wireless broadband technology that uses advanced orthogonal frequency multiplexing. Wi-LAN has patents on such technology in both Canada and the U.S. for that technology, which will be part of wireless broadband systems based on 802.16 technology, also known as WiMAX. While Wi-LAN expressed satisfaction about the settlement, Redline was less pleased. "We strongly believe that we do not infringe on their patents," Majed Sifri, Redline's president and CEO said in a statement. "However, it would have been too much of a distraction to challenge their claims as the royalty represents a minor portion of the overall Redline product cost. It made more sense to quickly reach an agreement so we could continue to focus on our core business."

Abstract:  The present invention relates to a new feature for e-mail services which provides a telephone call alert to a particular e-mail user when their e-mail server, web page e-mail server, or other e-mail receiving server receives new e-mail addressed to them. One or more designated telephone number (or numbers) are automatically called by an auto dialer at the e-mail server in response to the receipt of particularly identified high priority e-mail senders (e.g., from clients, from family, etc.). The particular designated telephone number(s) to call for a particular user are configured in a priority alert profile for that particular user, as are the possibility to limit the activation of the telephone call alert system to electronic messages received only from a select list of senders, and/or after a predetermined number of electronic messages have been received.

Abstract:  An advertising method utilizes a person's body, such as the skin of the person's upper back and shoulder region, which is ideally exposed, broad and planar. The advertisement may be displayed during a sporting/entertainment event which is broadcast to a large audience through visual media such as television. In one embodiment, the event is a boxing match and the advertisement affixed on the boxer's back promotes an on-line wagering service. The advertised service can be employed or accessed during the boxing match or immediately after the advertisement is seen by the consumer. The advertisement is sufficiently large to be legible and comprehensible by the viewing audience. The advertisement may be formed of a suitable dye, ink or paint that can be removed after the match, but which is resistant to smudging from physical contact and/or perspiration.
