Corporation today announced that it has filed suit against Hynix Semiconductor
in Japan and the United States, for infringement of Toshiba's semiconductor
memory patents. In Japan, Toshiba filed suit against Hynix Semiconductor Japan
Inc. for infringement of Toshiba's NAND flash memory patents in the Tokyo
District Court, on November 8 (Japan time and US time). Toshiba's suit in Tokyo
seeks damages against Hynix's infringement of three NAND-related patents, and an
injunction against infringing products. In the U.S., Toshiba has filed suit
against Hynix Semiconductor Inc. and its U.S. subsidiaries for infringement of
Toshiba's DRAM and NAND flash memory patents in the U.S. District Court for the
Northern District of Texas, on November 8 (U.S. time: November 9 Japan time).
The suit seeks damages for infringement of seven Toshiba patents, three related
to DRAM and four to NAND, and an injunction against infringing products. Toshiba
and Hynix entered into a patent cross-licensing agreement in August 1996 that
included semiconductor products. The companies started negotiation of an
extension of the agreement prior to its December 31, 2002 expiration, in which
Toshiba sought to secure a reasonable fee for access to its patents. Failure to
reach a satisfactory conclusion left Toshiba with no alternative other than to
pursue legal recourse.

law firm McKool Smith has extended its 3D graphics patent violation litigation
to target not just games publishers but hardware manufacturers. According to a
GameDailyBiz report, HP, Dell, IBM, Toshiba, Sony, Acer, MPC, Systemax, Fujitsu,
Matsushita, Averatec, Polywell, Sharp, Twinhead, Uniwill and JVC are all named
as defendants in the lawsuit. While the games publishers are alleged to have
infringed a single patent, 4,734,690, the hardware companies are accused of
transgressing six further patents. Like the first patent, the others were
granted to Tektronix.
Index Cendant sues Amazon.com,claiming patent

and rental-car giant Cendant Corp. has sued Amazon.com Inc., claiming the Web
site's "recommendations" feature infringes on a Cendant patent. The feature
tells customers who are interested in an item what other products were purchased
by customers who bought the same item. In a lawsuit filed Oct. 29 in the U.S.
District Court in Wilmington, Del., Cendant claims that Seattle-based Amazon is
infringing on its patent titled "System and Method for Providing Recommendation
of Goods or Services Based on Recorded Purchasing History." The patent was
issued to Cendant in August. New York-based Cendant didn't ask for specific
monetary damages in the lawsuit.

Apparatus and method to assist in
the diagnosis of premature ejaculation
Abstract: An
apparatus for providing a vibratory stimulus to the penis of a male human
comprising a cuff adapted to fit around the penis, which cuff includes one or
more vibratory means operable at a pre-determined or variable frequency. A
method of measuring premature ejaculation in a male human, said method
comprising the steps of: a) positioning a vibratable cuff to the penis of the
human; b) providing a vibratory stimulus having either a pre-determined constant
frequency or a variable frequency to induce ejaculation; c) measuring the
latency time period to ejaculation at said vibratory stimulus and/or the
threshold frequency required to induce ejaculation; and d) comparing said
latency measurement and/or said threshold frequency to known standard
measurements. A method of evaluating a novel potential therapeutic agent for the
treatment of premature ejaculation in a male patient. Initial assessment of
premature ejaculation can be made as a baseline measurement, and then novel
potential therapeutic agents administered to the patients.
